Terms & Conditions

1. Cropping Photographs: If you require permission to adapt, alter or manipulate, crop or over print a Frith photograph in any way, please contact us for further information;

2. VAT: All prices are subject to VAT at 17.5%.

3. Reproduction Fees: Are payable before use.

4. Search Fees: Over 100,000 Frith photographs may be viewed on this web site (http://library.francisfrith.com) or our partner web site www.francisfrith.com. If your requirements are particularly complicated we reserve the right to charge a Search Fee of £20.00 per hour payable by credit card prior to carrying out the work. After the first hour you may limit the amount of time we spend to 15-minute blocks at £5.00 per block.

5. Frith Credit & Proof copies: all reproductions of Frith photographs must be accompanied by the following credit: "Image(s) courtesy of The Francis Frith Collection at http://www.francisfrith.com" and proof copies of all publications must be supplied within one month of publication. If you fail to provide a credit for each image, an additional 50% of the original licence fee will be payable.

6. Charges for Unauthorised Use: You should be aware that reproduction of any Frith photograph without our prior written consent is a criminal act and we reserve the right to prosecute to the full extent of the law. Where we agree to accept a Reproduction Fee after publication this may be subject to a 100% surcharge of the normal fee.

7. Images provided by email, DVD or other digital means remain copyright The Francis Frith Collection and must not be used for any purpose other than that agreed and paid for, must not be passed to a third party & must be removed from all systems once the agreed use is achieved. This includes the destruction of any pre-press and pre-production copies. Images provided on CD or DVD must be returned to our offices within a month of publication.

8. No reproduction rights are granted by virtue of delivery of images unless expressly indicated. Your right to reproduce an image arises only if (a) the licence terms are agreed and (b) our invoice relating to the grant of such right is fully paid.

9. You must pay our invoice within 30 days of issue. However, in the case of newspaper, periodical & broadcasting use, only if we agree in advance, you may pay by the end of the calendar month immediately following publication or use, or within six months of the issue of our invoice, whichever is sooner.

10. Any licence granted will terminate immediately if you (a) enter into a voluntary or compulsory liquidation; (b) have a receiver appointed; or (c) fail to perform any of your obligations under these Terms & Conditions within 28 days of our giving you notice to comply. In the event of termination, all rights granted will immediately revert to us any further exploitation of any image shall constitute an infringement of copyright.

In purchasing the reproduction rights for an image from this web site you are agreeing to the above terms & conditions.
