For the purposes of this agreement, references to the Website shall, unless explicitly excluded, be deemed to include the Embedding Service.

Where enabled, you may embed Frith material on a website, blog or social media platform using code provided to you via the Website (the Embedding Service). Not all Frith content will be available for use with the Embedding Service, and availability may change without notice. You agree not to alter the code provided to you by the Embedding Service and you acknowledge that the code is provided as-is and without warranty of any kind. Frith reserves the right in its sole discretion to remove any Frith content from the Embedding Service. Upon request, you agree to take prompt action to stop using the Embedding Service and/or Frith content. You may only use the Embedding Service for editorial purposes (meaning relating to events that are newsworthy or of public interest). The Embedding Service may not be used: (a) for any commercial purpose (for example, in advertising, promotions or merchandising) or to suggest endorsement or sponsorship; (b) in violation of any stated restriction; (c) in a defamatory, pornographic or otherwise unlawful manner; (d) in any way that Frith may deem in its discretion to compete with or cause harm to Frith or Frith's interests; or (e) outside of the context of the Embedding Service. Use of Frith content for commercial purposes will be considered a fundamental breach of these terms and conditions of use.
Frith, or third parties acting on its behalf, may collect data related to use of the Embedding Service and embedded Frith content, and Frith reserves the right to monetise the Embedding Service as it sees fit, in its sole discretion, without any compensation to you.
Certain links in the Website will lead to other websites which are not under the control of Frith. When you activate any of these you will leave the Frith Website and Frith has no control over and will accept no responsibility or liability for the material on any website which is not under the control of Frith.
Conditions relating to the sale of products to you
When you place an order to purchase a product from the Website, we will send you an e-mail confirming receipt of your order and containing the details of your order. Your order represents an offer to us to purchase a product which is accepted by us when we send e-mail confirmation to you that we've dispatched that product to you (the "Dispatch Confirmation E-mail"). That acceptance will be complete at the time we send the Dispatch Confirmation E-mail to you. Any products on the same order which we have not confirmed in a Dispatch Confirmation E-mail to have been dispatched do not form part of that contract.
Orders placed via the Website may, at the discretion of Frith, be fulfilled by an authorised distribution agent for Frith ("the Agent") in the delivery country or territory specified within your order. Orders for delivery within the United Kingdom will be placed with Heritage Content Company Limited by Frith on your behalf as the Agent within the United Kingdom. When Frith places your order with the Agent on your behalf, your contract of sale will be with the Agent.
Returns and guarantee of satisfaction
Please review our Returns Policy, which applies to products purchased from us. In addition to your 30-day returns guarantee, customers in the European Union are entitled to a statutory cooling-off period of seven business days.
Customs and overseas delivery
When ordering goods for delivery overseas you may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country, so you should contact your local customs office for further information. Additionally, please note that when placing your order via the Website, you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the goods. Your privacy is important to us and we know that you care about how information about your order is used and shared. We would like our international customers and customers dispatching products internationally to be aware that cross-border deliveries are subject to opening and inspection by customs authorities.

"The Francis Frith Collection", "Frith" and "Frith's Photo Pictures" names and logos are copyright registered trade marks used by Frith on the Website under licence by from Heritage Photographic Resources Ltd and must not be used in any form for any purpose whatsoever by any other party without the prior written permission of Heritage Photographic Resources Ltd.
Copyright and Ownership
All rights in the Website, including but not limited to all text, images, design, code, databases and all data contained therein are the sole and exclusive property of Frith unless otherwise explicitly stated and no rights shall be acquired nor accrued in any materials displayed on the Website through use of, or by way of inclusion in, the Website. Any use of materials on the Website without Frith's prior written consent is expressly prohibited.
All photographs, photograph catalogue information and author text featured on the Website are the exclusive copyright property of Heritage Photographic Resources limited unless otherwise explicitly stated. No rights are granted or implied to any photograph through inclusion in the Website.
You may not systematically extract and/or re-utilise parts of the contents of the Website without Frith's express written consent. In particular, you may not utilise any data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) for re-utilisation of any parts of this website, without Frith's express written consent.
